Maybe, perhaps he’s entitled to zero. Maybe he sends calls that aren’t collectable. I can keep going on with maybe.. Maybe we don’t understand why.

No, he hasn’t. I have denied many people compensation. They also never offered compensation for my legal bills for the collection issues I have incurred.

He can become licensed, file a tariff, and do collections on his own traffic.

I completely disagree. A small hosted PBX company shouldn’t be relying on TFO collections. If it is a basis for your company, I would think its fraud. However, one bad apple can cause HUGE issues on your relationships as a LEC.

As I see it, he had nothing to lose, everything to gain, and may, depending on the specifics and realities of the case, even have done a public service.

I offer zero compensation on TFO. Why? Because it has been the most fraud laced product I have ever seen, and your damn right that the ilecs can bury our asses with legal.

I am not even going to respond to an agents stake in this because there is none. They just want payments, and they don’t care what that means. I am not defending Teliax, I have no idea of their position. I did read a lot of responses of people who don’t have a proper understanding of TFO collections.

Good night.

Also, on the question of whether the vendor in question are "fraudsters": Sometimes, bureaucratic inanity is functionally indistinguishable from wilful fraud, in the sense that someone who is contractually entitled to a payment doesn't get paid. It's the same basic reason as for the existence of the concept of statutory negligence, wherein you can be charged with criminal negligence for bringing an alligator to a public building even if you did not intend it to harm anyone and even if, in fact, you took steps to prevent that. -- Alex Balashov | Principal | Evariste Systems LLC 303 Perimeter Center North, Suite 300 Atlanta, GA 30346 United States Tel: +1-800-250-5920 (toll-free) / +1-678-954-0671 (direct) Web: http://www.evaristesys.com/, http://www.csrpswitch.com/ -- _____________________________________________________________________ -- Bandwidth and Colocation Provided by http://www.api-digital.com -- asterisk-biz mailing list To UNSUBSCRIBE or update options visit: http://lists.digium.com/mailman/listinfo/asterisk-biz

Maybe. All completely possible. My position is premised on the truth of
the claims submitted by Nitzan, the most materially significant of which
strikes me as being:

"... CEO David Aldworth ... acknowledged they owe us $833
and assured me payment will be sent."

It seems to me that if the traffic did not qualify, they wouldn't make
that admission.

And yes, I am willing to assume that Nitzan isn't straight-up lying to
the list. Smile Perhaps you're not.

Also, I don't think Nitzan said anywhere that TFO compensation is "a
basis" for his company or even that he's "relying" on it. That doesn't
mean he should just shrug and ignore it.

Who said anyone was "relying" on income from TFO? And does taking your
advice mean that one should simply forget about collecting it, even when
a carrier promised it to you, and furthermore, admitted that they owe
you it?

Teliax never disputed the amounts they owed us - they in fact kept telling us that yes - we're owed this much - and payment is "coming soon". The typical run-around.

Good for you. How is this relevant? our calls are legit residential traffic.

Who promised something? There should be a contract that said customer can use to enforce their claim. I think they may be relying upon it at some level. Just assumptions. We all know how that goes.
Either way the customer has a possible claim and we are all arguing over an intangible issue which we have no data. I don't even want the data because I don't care. I just don't care for the burning at the stake mentality simply because he may be the little guy.

Alex, you are a respected colleague. This is a shit show, and I regret getting involved. We don't know any facts yet we are all taking sides.

I won't respond beyond this as I have no stake, and it's unprofessional now for me to do so.
